1. Agreement to these Terms

The website at stoeber4sb.org and its related pages, forms, and online features (collectively, the "Site") are operated by Alexander Stoeber for City Council 2026 (the "Committee," "we," "us," or "our"), a California political campaign committee supporting Alexander Stoeber for Santa Barbara City Council, District 6.

By accessing or using the Site, or by opting in to our SMS text messaging program, you agree to these Terms of Service (the "Terms") and acknowledge the Privacy Policy. If you do not agree, do not use the Site and do not opt in to text messages. Additional terms presented at the point of a donation, event registration, text-message signup, volunteer activity, or third-party service also apply to that transaction or activity.

2. SMS text messaging terms and conditions

These SMS Terms and Conditions govern the Alexander Stoeber for City Council 2026 text messaging program (the "Program"). By providing your mobile number and giving express written consent, you agree to these SMS Terms.

3. This is a campaign website

The Site is a political campaign website. It is not operated by, affiliated with, or endorsed by the City of Santa Barbara, Santa Barbara County, the State of California, any election administrator, or any other government agency.

Site content is provided for campaign communication and general informational purposes. It is not an official government notice and does not constitute legal, tax, financial, investment, medical, or real estate advice.

The Committee maintains its branding, communications, records, contact data, and operations separately from Stoeber Agency, Compass, AbundantSB, and Alexander Stoeber's other professional or publishing activity. No campaign content is offered in a professional real estate capacity, and the Site does not imply endorsement by any employer, brokerage, publication, client, or affiliated organization.

4. Eligibility, age, and children

You must be at least 18 years old to opt in to the SMS text messaging program described in Section 2.

The Site is intended for a general audience and is not directed to children under 13. Do not submit personal information through the Site if you are under 13. We do not knowingly collect personal information online from a child under 13. If we learn that we have done so, we will take reasonable steps to delete it.

You may donate, enter into an agreement, or participate in an activity only if you are legally permitted to do so and can truthfully provide any certifications required for that activity. A parent or legal guardian should supervise a minor's campaign participation when appropriate.

5. Political contributions

Contributions are governed by applicable federal law, California law, the Santa Barbara Municipal Election Campaign Disclosure Ordinance, the Committee's filed election documents, and instructions approved by the Committee's treasurer.

By making a contribution, you represent and certify that:

Required contributor information and public disclosure

California campaign-finance law requires campaign committees to keep contributor records and publicly report contributions as required by law. Contributions aggregating to $100 or more generally must be itemized with the contributor's name and street address; when the contributor is an individual, occupation and employer information is also required. A contribution of $100 or more may have to be returned if required contributor information is not obtained within the legally permitted period.

Campaign disclosure filings are public records. Information reported publicly may remain available through government filing systems even after the Committee's own retention period ends. Mobile phone numbers are not included in campaign-finance filings by the Committee.

Contribution processing, refunds, and taxes

Contributions are not charitable donations and are not tax deductible as charitable contributions. The Committee may decline, void, refund, or return any contribution, including a contribution that is excessive, incomplete, unauthorized, from a prohibited source, inconsistent with treasurer-approved policy, or otherwise unlawful.

Except when required by law or approved by the treasurer, contributions are final. A request for a refund does not guarantee a refund. If only part of a contribution is unlawful or excessive, the Committee may return the affected amount.

Online contributions are handled through a third-party payment service. The payment service's terms and privacy practices also apply. Payment-service fees may be charged to the Committee as disclosed on the donation form.

6. Email communications

If you sign up for campaign email, we may send updates, event notices, volunteer requests, fundraising messages, and other political communications. You may unsubscribe using the link in an email or at the unsubscribe page. We may still send a limited transactional message necessary to complete an action you requested, such as a donation receipt or event confirmation.

Unsubscribing from email does not remove you from the SMS program, and replying STOP to a text does not remove you from email. Each channel is managed separately, and you may opt out of either or both at any time.

7. Information and materials you submit

The Site may allow you to send a question, policy idea, volunteer information, photograph, testimonial, endorsement, event material, or other content (a "Submission"). You retain any ownership rights you have in your Submission.

By submitting material, you represent that you have the right to provide it and grant the Committee a non-exclusive, worldwide, royalty-free license to store, copy, review, adapt, and use it as reasonably necessary to respond to you, administer the campaign, comply with law, and perform the purpose for which you submitted it.

Public use requires separate permission. Unless your form clearly states otherwise or you separately authorize public use, we will not publish your name, likeness, personal story, endorsement, photograph, or quotation as a campaign testimonial merely because you submitted it privately.

Do not send confidential information, privileged material, sensitive personal information that is unnecessary for the request, content you do not have the right to share, or unlawful, threatening, defamatory, harassing, deceptive, or infringing material. We may remove, disregard, preserve, or disclose a Submission when reasonably necessary to operate the Site, protect rights or safety, investigate misuse, or comply with law.

8. Site content, campaign marks, and fair use

The Site's original text, design, graphics, photographs, video, code, and campaign identifiers—including the STOEBER wordmark and "A Future Here"—are owned by or licensed to the Committee and are protected by applicable law.

You may link to the Site and share unaltered campaign materials for personal, news, commentary, educational, or noncommercial political discussion. You may not use Site content or campaign marks to falsely imply endorsement, impersonate the campaign, misrepresent a campaign position, raise money without authorization, or promote a commercial product or service.

Nothing in these Terms limits rights available under fair use, the First Amendment, or other applicable law.

9. Acceptable use

You agree not to:

• break the law or use the Site or the SMS Program to facilitate unlawful conduct;
• enroll a mobile number you are not the subscriber or authorized user of;
• contribute in another person's name, conceal the true source of funds, use an unauthorized payment method, or submit false contributor information;
• impersonate a person or organization or falsely state an affiliation;
• interfere with Site or Program availability, security, forms, databases, or connected services;
• introduce malicious code or attempt unauthorized access;
• harvest personal information, send spam, or use automated tools in a way that imposes an unreasonable burden or violates law;
• circumvent access controls or use Site content to create deceptive campaign communications.

Reasonable indexing by general-purpose search engines and good-faith security research conducted lawfully and reported responsibly are not prohibited by this section.

10. Third-party links and services

The Site may use or link to third-party services for payments, forms, customer-relationship management, email, text messaging, video, social media, maps, analytics, accessibility, events, or other functions. Third parties operate under their own terms and privacy policies. A link or integration does not necessarily mean the Committee endorses every statement, product, or practice of the third party.

We are not responsible for a third party's availability, content, security, or handling of information, except to the extent responsibility cannot be excluded under applicable law.

11. Privacy and security

The Privacy Policy describes the categories of information collected through the Site and the SMS Program, the purposes for which it is used, disclosures to service providers and other recipients, our data security practices, retention periods, and the rights and choices available to you. The Privacy Policy is incorporated into these Terms by reference.

No website or transmission method is completely secure. We use reasonable administrative, technical, and organizational measures appropriate to the Site, but we cannot guarantee that information will never be lost, misused, accessed without authorization, or affected by a service interruption.

12. Election and voter information

Any election date, registration deadline, voting-location information, ballot instruction, district information, or election result appearing on the Site or in a campaign text message is provided for campaign convenience and may change or become outdated. Confirm voting information directly with the public agency administering the election.

The Committee does not determine voter eligibility, registration status, ballot acceptance, vote-center availability, election results, or certification.

13. Disclaimers

The Site and the SMS Program are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, the Committee disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We work to keep campaign information accurate and useful, but we do not promise that every page, message, policy description, event detail, link, figure, form, or third-party integration will always be complete, current, uninterrupted, secure, or error free. We do not warrant that messages will be delivered on time or at all.

Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, the Committee and its candidate, officers, treasurer, employees, contractors, volunteers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, opportunity, or profits, arising from or related to the Site or the SMS Program, even if advised that such loss is possible.

To the fullest extent permitted by law, the total aggregate liability of the Committee parties for claims arising from or related to the Site, the SMS Program, or these Terms will not exceed the greater of (a) the amount you paid directly to the Committee for a Site-related service that gave rise to the claim, excluding political contributions, or (b) one hundred dollars ($100).

These limitations do not apply to liability that cannot be limited or excluded under applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Committee and its candidate, officers, treasurer, employees, contractors, volunteers, and agents from third-party claims, liabilities, damages, judgments, and reasonable costs arising from your unlawful misuse of the Site or the SMS Program, your material violation of these Terms, your enrollment of a mobile number you were not authorized to provide, or a Submission that infringes another person's rights.

This section does not require indemnification for the Committee's own unlawful conduct, gross negligence, or willful misconduct.

16. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to any rights or procedures that cannot lawfully be waived, a legal action arising from these Terms, the Site, or the SMS Program must be brought in a state or federal court with jurisdiction in Santa Barbara County, California.

17. Changes to the Terms and Site access

We may update these Terms prospectively. The "Last updated" date identifies the version posted on the Site. A material change will be presented through a reasonable notice when appropriate. Your continued use of the Site, or continued participation in the SMS Program, after an updated version becomes effective constitutes acceptance of the revised Terms.

We may modify, suspend, restrict, or discontinue any part of the Site or the SMS Program and may block access when reasonably necessary to protect the Site, users, the Committee, or compliance with law. Provisions that by their nature should continue—including ownership, disclaimers, liability limits, indemnification, and general provisions—survive termination of access.

18. General provisions

These Terms and the Privacy Policy constitute the agreement between you and the Committee concerning the Site and the SMS Program, except for additional terms presented for a specific transaction or activity.

If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. Headings are for convenience only.

You may not assign these Terms without our written consent. The Committee may assign or transfer its rights and obligations as permitted by law, including to a lawful successor committee, service provider, or records custodian, subject to applicable campaign-finance and privacy obligations.

19. Accessibility

We want campaign information to be usable by every neighbor. We work to improve accessibility and aim to follow recognized accessibility guidance where reasonably practicable.
